An IRS audit letter can leave you wondering whether the return you filed was wrong, especially if you’re also running a business. Selection alone doesn’t establish an error. For a questioned business deduction, the payment amount is only part of the explanation. Your receipt and response need to connect the purchase with its use in your business.
Your response is about the entries the examiner identified in the letter. With the return for that tax year open, you can see which records support the questioned income or deductions. Some figures may need a written explanation along with the documents. You also have the right to challenge findings you disagree with during the examination.
An IRS audit is an IRS examination by mail or in person to check your reported income, deductions and tax against the records supporting your filed return. The letter tells you which tax year and items the IRS is reviewing, along with the response deadline. You don’t automatically owe additional tax because the IRS selected your return.
An IRS audit may begin with random selection, computer screening or questions about transactions involving another taxpayer whose return the IRS is examining. You can’t tell from selection alone that your tax position is wrong.
El IRS selection methods include comparisons with patterns from similar returns. Examinations of a randomly selected sample of tax returns give the agency those comparison standards. A statistical comparison is part of deciding which returns to review, rather than a finding that a particular expense isn’t deductible.
Your return may also come under examination because of dealings with a business partner or investor whose return the IRS is reviewing. That connection can bring related transactions into an IRS audit without establishing that you made an error. A refund, one deduction or your income level doesn’t guarantee selection.
Look for wording that says the IRS is examining a specific federal tax return. A payment request alone doesn’t establish an IRS audit. The tax year and questioned items on an audit letter show what needs support. You’ll be notified by mail when an examination begins.
| Letter | What it concerns |
|---|---|
| Examination letter | Reviewing return items and supporting evidence |
| CP2000 | Proposed changes based on mismatched information |
| Balance-due notice | Tax the IRS says you owe |
CP2000 flags a reporting mismatch; it isn’t an audit or bill. The Aviso CP2000 proposes adjustments based on information others sent the IRS about you.
Your letter’s number identifies the type of issue, but the letter supplies the document request, delivery instructions and deadline. Another notice may allow a different response period.
Whether you’ll mail records or attend an IRS audit interview depends on the letter. Your notice gives the format, any meeting location and response instructions. The IRS describes mail and interview audit methods.
| Tipo | How it happens | Qué hay que preparar |
|---|---|---|
| Correspondence | Written requests by mail | Copies supporting the questioned items |
| Office | Meeting at an IRS office | Requested records for the interview |
| Field | Meeting at your home, business or representative's office | Books and records the examiner requests |
Un in-person examination includes an interview about your records. For a business return, the examiner may ask about business operations to understand where the figures on your return came from.
If you’ve got too many books or records to mail, you can ask for a face-to-face examination. Use the contact details in the IRS letter to discuss the request.
An IRS audit may involve income records or proof supporting deductions. Find the return for the year in your notice, then locate the line or schedule the IRS wants you to explain. Match the requested records with the entries under review.
The examiner needs the purchase details and payment dates, with the recipient identified. A bill or invoice belongs with payment evidence, such as a canceled check for a purchase paid that way.
Why did you deduct the expense? A bank statement may show you paid it, without explaining the business or tax reason behind the deduction.
Keep the copies for each tax year together in your IRS audit response, separated by income or expense. Use a transaction summary to connect the reported amounts. Label each record with the questioned return entry it supports, and keep your originals.
The amounts you’re being asked to explain come from a filed return. With that year’s copy open, you can locate the entries behind the IRS audit request.
Mail examinations call for a written extension request by fax, or by mail if you can’t fax it. For an in-person examination, contact the assigned auditor. A statutory notice of deficiency, which proposes additional tax, has a Tax Court petition deadline the IRS can’t extend.
If you can’t connect the requested records to what you filed, consider professional review before responding.
You don’t have to agree with the examiner’s proposed changes during an IRS audit. Under the IRS’s derechos de los contribuyentes, you can submit evidence supporting your return and choose a representative to speak for you.
| Right | What it means during an examination |
|---|---|
| Understanding decisions | The IRS must explain its decisions and examination procedures clearly. |
| Privacidad y confidencialidad | The IRS can't disclose your information without your permission unless the law allows it. The examination must avoid unnecessary intrusion. |
| Representación | Choose an eligible person to represent you in your dealings with the IRS. |
| Objections and appeals | The IRS must consider timely objections promptly and fairly. Qualifying decisions can go to independent review. |
| The amount you owe | Tax, interest and penalties cannot exceed the amount legally due. The IRS must credit your payments correctly. |
You’re still responsible for supplying required information when you object. Explain the disputed return entry with supporting records; the right to challenge doesn’t guarantee a favorable result. The IRS must respond when it rejects your position. Independent review of an eligible decision places the dispute before someone outside the examination.
The tax years covered by an IRS audit don’t tell you when the examination will finish. That depends on the issues involved, available records, scheduling and disagreements; there’s no standard completion time.
The IRS generally reviews returns filed in the past three years. If it finds a substantial error, it may include older returns, usually without going back more than six years. Its audit timing guidance describes those usual practices.
The legal deadline to assess, or formally record, additional tax is generally three years from the return’s due date or filing date, whichever is later. Certain income omissions and agreed extensions can change that deadline. Unfiled or fraudulent returns can leave the IRS with unlimited time to assess tax. Check the assessment time limits using your return’s filing date and applicable due date.
An IRS audit can end without changes to your return. If the IRS proposes changes, accepting them makes the result “agreed”; disputing them makes it “disagreed.” Together with “no change,” these are its audit outcomes.
| Resultado | Significado | Next consideration |
|---|---|---|
| No change | You've supported every item the examiner reviewed. | File the written result with that year's return. |
| Agreed | You understand the examiner's proposed changes and agree with them. | Check the examination report before deciding to sign. |
| Disagreed | You understand the proposed adjustments but contest them. | Read the response instructions for the disputed findings. |
Signing the report tells the IRS you agree with its findings. Look at the adjusted return entries and the resulting tax calculation before making that decision. Additional tax may come with interest or penalties, depending on the circumstances. If there’s a balance due, review payment options before deciding how you’ll pay it.
Compare the proposed IRS audit finding with the entry on your filed return and its supporting records. The examiner can explain the adjustment. You can also request a manager conference. Document requests carry their own deadlines.
For disputed IRS audit findings, Appeals review may be available. Check your letter for the time allowed to submit a written protest explaining your disagreement, generally 30 days from the letter’s date. Your protest should show how the records support your filed return. Send your Solicitud de apelación using the letter’s address and instructions.
The IRS proposes additional tax in a statutory notice of deficiency. You generally have 90 days from the notice’s date to petition Tax Court. The period becomes 150 days when your address on the notice is outside the United States or you’re abroad when it’s mailed. Check the Tax Court deadline on that notice. A general Appeals request or extra time to answer an initial audit request doesn’t extend it.
No inventes registros.
Keep your response copy with proof of receipt, which you request from the carrier. For certain qualifying notices, online account status checks can also help. The IRS explains the available tools in its response confirmation orientación.
Can you explain the questioned amount using the return and records you have? A mail request limited to one issue may be a response you can handle yourself, provided your records support the entry questioned during that IRS audit.
Disputed deductions on Schedule C, a sole proprietor’s business income and expense schedule, may need professional review of the records, particularly when the IRS asks for complicated proof supporting those claimed expenses. Seek review if income and books don’t agree, or bookkeeping entries are missing. Several tax years, an examination in person and proposed adjustments can also call for professional help before responding.
CPAs, attorneys and enrolled agents can generally represent you on any IRS matter under the representation credentials rules. That doesn’t give someone authority over every year you’ve filed. Your authorization, commonly Formulario 2848, sets the matters and tax periods covered. Check that scope when choosing representation options.
Qualifying taxpayers may receive representation through Low Income Taxpayer Clinics. For hardship or IRS system problems, the Taxpayer Advocate offers a different kind of assistance from private representation.
